Quasi-Book Review: Communications Law and Policy in the Digital ...

Why does changing policy matter to you? Keep reading.

?Our clients reflect the start-up scene in Boston and beyond? they are innovators, often disruptive ones.? Innovators are not happy to stick with the status quo. Where they see a market need, they see an opportunity, and they don?t particularly mind if some toes get stepped on along the way.? Some companies are succumbed by new technology, new ideas, and new means of delivering products and services, some recognize the value of the change (sometimes buying out the ?upstart? in the process), and still others fight tooth and nail to hold on to what they feel rightfully belongs to them.? Oftentimes, the market (through consumers voting with their dollars) triumphs.?

?But when a regulation or law, often outdated, is what stands in the way, the conversation takes on an entirely different tone.? The consumer outcry can be quick?such as the threat to Uber?s alternative taxi service? or it can be more drawn out.? These are the cases where the entrenched industry shows up, with figurative guns drawn, battling through lobbyists to protect its position from young upstarts (think RIAA).? But even without these epic battles, policymakers regularly have to decide when the laws need to be updated to reflect new technologies, and how to do it.? It?s trickier than it seems.? In the moment, policymakers don?t always know what technologies will stick around and which will be a passing phenomenon.? After all, there was a time when Washington was convinced that AOL was going to take over the world.? And who still has a Palm Pilot stuck in a drawer some place?

?New companies with new technologies can?t sit around and wait for law to catch up.? Part of the fun of our job is to keep pace with legal and technological trends.? Whether its green technology, a new search algorithm, an exciting new way of matching users and providers, or new graphics, applications, or devices?we can play a role in steering our clients away from risks under the current system, and anticipating what they may face next.

?So how does the book fit in? Communications Law and Policy in the Digital Age??follows these developments in the law regarding communications technology.? It does its best to forecast what changes need to be made and the best way of doing so? guessing which technologies might be worth the long-term investment through legal change and highlighting areas where the current system isn?t working.? This overview helps you access some of the same information that affects our guidance.? And it gives you insight into the process that insightful entrepreneurs? the ones that make Boston so great? can use to design their products and services in anticipation of legal changes.? Use the book as a blueprint for what changes may be necessary and what opportunities those may create for you.? And do it before everyone else is left scrambling to react to the changes when they happen.? Or, get in there and fight for the changes you want.? We?ll be watching.?
