Top senators agree on tough penalties on Iran (AP)

WASHINGTON ? Determined to weaken Iran economically, a top Senate Democrat and Republican on Monday unveiled a bill to impose sweeping new penalties on Tehran and thwart its nuclear ambitions.

Senate Banking Committee Chairman Tim Johnson, D-S.D., and Alabama Sen. Richard Shelby, the panel's top Republican, said they had agreed on the measure that would target Iran's Revolutionary Guard Corps, require companies that trade on the U.S. stock exchange to disclose any Iran-related business to the Securities and Exchange Commission, and expand penalties for energy and uranium mining joint ventures with Tehran.

The bill also would deny visas and freeze assets on individuals and companies that supply Iran with technology that could be used to crack down on its citizens, such as tear gas, rubber bullets and surveillance equipment.

Johnson and Shelby said their committee would consider the legislation on Thursday.

"A nuclear-armed Iran would represent a grave threat to regional peace and international security," Johnson said in a joint statement with Shelby. "Iran's continuing defiance of its international legal obligations and refusal to come clean on its nuclear program underscore the need to further isolate Iran and its leaders."

Shelby said the bill "sends a clear signal through strong measures that Iran must abandon its nuclear weapons program and its designs for the spread of international terror."

A report in November suggested that some of the Islamic Republic's alleged experiments could have no other purpose than developing nuclear weapons. Iran contends that its program is designed to generate electricity, not build weapons. A U.N. inspection team currently is in the country.

Both the Obama administration and the international community have imposed tough sanctions on Iran. Johnson and Shelby said those penalties have been insufficient in deterring Tehran from pursuing a nuclear weapon.

Among the provisions of the legislation is an expansion of U.S. sanctions to include companies involved in joint energy ventures anywhere in the world in which Tehran is a significant partner or investor. The penalties also would apply if Iran receives energy technology or information that wasn't previously available to the government.

Penalties also would be imposed on companies involved in a joint venture with Iran in the mining, production or transportation of uranium. Individuals who agree to abandon such projects within six months would be exempt from the penalties.

The legislation would require the president to identify and designate officials, affiliates and agents of the Revolutionary Guard Corps. These individuals would be subject to sanctions and barred from the United States. Individuals or companies that engage in transactions with the Revolutionary Guard Corps, even through bartering, also would be subject to sanctions.

Penalties also would be mandatory for shippers or insurers who knowingly aid the shipment of materials that contribute to Iran's weapons of mass destruction or terrorism-related activities.

The bill is likely to garner strong bipartisan support. Last year, the Senate voted 100-0 for a measure sponsored by Sens. Bob Menendez, D-N.J., and Mark Kirk, R-Ill., to the annual defense bill that targeted financial institutions that do business with Iran's Central Bank. President Barack Obama signed the wide-ranging defense bill on Dec. 31.

(AP) ? Authorities investigating the deaths of three family members found dead in a central Virginia home have confirmed that the victims were a man and his 3-year-old, twin daughters.

The Hanover County Sheriff's office on Sunday identified the man as 40-year-old Robert D. King and the girls as Caroline R. and Madison R. King.

All three bodies were found late Saturday in a ranch-style home in the Richmond suburb of Mechanicsville.

Hanover Sheriff's Sgt. Chris Whitley said the cause of death has not been determined.

He called the deaths suspicious but said no suspect is being sought.

Whitley said the twins lived with their mother in the home where the bodies were found. Robert A. King lived at a different address in Hanover County.

Officer shot, killed by fellow police in Calif.

(AP) ? A police officer under investigation for sexual misconduct with a teenage minor was shot and killed while on duty by fellow officers Saturday as they tried to arrest him on California's central coast, authorities said.

The officer was manning a DUI checkpoint when the shooting occurred shortly after 1 a.m. He was declared dead after emergency surgery at Marian Medical Center, Santa Maria police Chief Danny Macagni said in a statement.

The officer, a four-year Santa Maria department veteran, had just learned of the internal investigation of an alleged sexual relationship with a 17-year-old girl, and it became necessary to arrest him immediately, Macagni said.

"We had no choice," Macagni said in video of an afternoon news conference posted by KCOY-TV. He said investigators had evidence "that demanded that we go out and take this officer off the street immediately."

Supervising officers were sent to make a felony arrest, but he struggled with them when they arrived, first putting up a physical fight, then firing his gun but hitting no one, Macagni said.

"He chose to resist, he drew his weapon, a fight ensued, he fired his weapon," the chief said.

Several officers came to help the police making the arrest, and one of them shot the suspected officer in the chest once, Macagni said.

Detectives had begun investigating the alleged relationship on Thursday night, and minutes before the shooting had confirmed that an "inappropriate" and "very explicit" relationship had been going on, Macagni said.

He said he could not give details because of the sensitivity of the investigation, but "there was some witness intimidation involved" and the arrest couldn't wait for a more proper time or place.

"The information that we had in hand demanded that we not let him leave that scene, get in a car, drive somewhere, it would put the public at risk," Macagni said at the news conference. "We just did not know what was going to happen, we did not expect him to react the way that he did."

Macagni said police had expressed condolences to the officer's family.

The officer who fired the fatal shot, an eight-year department veteran, has been placed on administrative leave, and the Santa Barbara County Sheriff's Department was investigating the shooting, Macagni said.

The name of the officer killed has not been released because some family members were still being notified, and the name of the officer who fired the shot was withheld while the incident was under investigation, police said.

Santa Maria is a city of some 100,000 people about 60 miles northwest of Santa Barbara and 160 miles northwest of downtown Los Angeles.

Yemen's Saleh heads for United States (Reuters)

ADEN (Reuters) ? President Ali Abdullah Saleh was heading to the United States on Saturday, Yemen's state news agency said, a week after leaving for Oman under a plan for him to step down to end a year of protests against his rule.

In London, a foreign office official said Saleh's plane had stopped at a British airport en route to the United States.

The state news agency said he had left the Omani capital Muscat, his home for the past week, to receive medical treatment.

Saleh has transferred some powers to his deputy and enjoys immunity from prosecution under a deal meant to end increasing instability in Yemen.

The deal also established a transitional government including the opposition and envisions restructuring Yemen's armed forces, key units of which are led by Saleh's relatives.

The United States, which endorsed the plan to coax Saleh out of office by granting him immunity from prosecution over the deaths of protesters, had defended its decision to issue him a visa, despite criticism that it would be seen as sheltering him.

Saleh had originally been expected to stop only briefly in Oman after leaving the Yemeni capital Sanaa last Sunday. He had said in a parting speech he would return to Yemen.

A foreign diplomat in Oman said, however, that Saleh had sought permission to reside there. An Omani government source declined to confirm or deny receiving such a request, but said Oman would be reluctant to agree to it in case this harmed future ties with Yemen.

The United States and Saudi Arabia fear protracted political upheaval in Yemen could give al Qaeda's regional wing a foothold near oil shipping routes through the Red Sea.

Underlining the continued violence, Yemeni troops killed four Islamist fighters in the southern town of Zinjibar, a local official said on Saturday.

He said the four fighters from Ansar al-Shariah were killed in a skirmish on the eastern edge of Zinjibar, which Islamists fighters overran last May. One soldier was killed in the fighting late on Friday, he said.

A spokesman for the Islamist group said his side had suffered no casualties, but confirmed the account of a soldier's death.

Saleh's foes accuse him of deliberately ceding territory to Islamists to make himself indispensable to his former U.S. patrons, and of ultimately aiming to sabotage the political transition and retain power for his inner circle.

Blood found at home where Maine tot was last seen (AP)

PORTLAND, Maine ? Investigators have been analyzing blood found in the basement of a Maine home where a missing toddler was last seen six weeks ago, an official said Saturday.

The blood was found early in the investigation into Ayla Reynolds' disappearance from her father's home in Waterville, state police spokesman Steve McCausland said. The state crime laboratory has been running tests on it since then, but it was unclear when results would be available.

Ayla's father, Justin DiPietro, reported her missing Dec. 17. He had put her to bed the night before in the home he shares with his mother and said she wasn't there the next morning.

McCausland called the discovery of the blood "troubling." He declined to discuss how much blood was found in the basement or how old it might have been.

Ayla was 20 months old when she disappeared. She had been staying with her father at the time in the house where DiPietro lives with his mother. Her mother, Trista Reynolds, lives in Portland.

DiPietro told police she was wearing green pajamas with polka dots and the words "Daddy's Princess" on them and had a soft cast on her broken left arm.

DiPietro, his mother and a third adult were home the night of Dec. 16, and police have questioned all three, McCausland said.

"We believe they have not given us the full story," he said.

Trista Reynolds was participating in a vigil Saturday for the girl and could not be reached for comment. DiPietro did not immediately return a message left on his cellphone.

The two came face to face for the first time since Ayla's disappearance at the vigil on the City Hall steps in downtown Waterville, said Bob Vear, a friend of the DiPietro family who organized the vigil. They spoke privately for about 10 minutes before giving each other a hug, Vear said.

A woman who answered DiPietro's mother's cellphone hung up after being asked about the blood.

The blood was among hundreds of pieces of potential evidence that were removed from their home as part of a criminal investigation into the girl's disappearance. The discovery of the blood was first reported Saturday by WCVB-TV in Boston.

Ronald Reynolds, who is Trista Reynolds' father, said DiPietro hasn't been forthcoming with his version of what happened or what he knows. DiPietro has said he took a polygraph test, but has declined to say what the results were.

"They haven't given the full story, but this family has gone through so much pain, so much hurt," said Reynolds, who lives in Portland. "We're going into two months now and don't know anything, and all we get is the runaround."

Vear said he was first made aware of the blood sample Dec. 24, but he doesn't think it'll amount to anything.

"I cut myself at home all the time," he said. "It could be Justin's, it could be the baby's. There were five or six people in the house that night."

How a typo led to a marriage

The next time you make a particularly strange typo, don't throw your keyboard out the window ? instead just smile. Smile, because it's possible for a simple typo to lead to a marriage.

After all, it was a typo that brought together?Rachel P. Salazar and Ruben P. Salazar despite the fact that they lived?about 9,000 miles apart and were "completely unaware of each other's existence."

Apparently an email intended for Rachel accidentally went to Ruben ??thanks to their similar email addresses and some sloppy typing skills?? in Jan. 2007. Ruben politely forwarded that email along to its intended recipient and began an email chain that led to a marriage proposal.

Indians manager: Carmona important to rotation (AP)

SANTO DOMINGO, Dominican Republic ? Cleveland Indians manager Manny Acta says the pitcher known as Fausto Carmona is an important part of the rotation and the team is doing what it can to speed up his arrival.

Acta told The Associated Press late Monday that the team is making the necessary moves to get Carmona to the United States for the coming season but also will be prepared to go without him.

Says Acta: "It doesn't matter that he was a little inconsistent last year. Fausto is an important part of our rotation."

Carmona is accused of using a false identity to play baseball in the U.S. and faces a judicial process in the Dominican Republic. He was released from jail on Friday.

Carmona's real name is Roberto Hernandez Heredia. He's 31, three years older than he had claimed.

Google to unify privacy policy across products (Reuters)

(Reuters) ? Google Inc plans to unify its privacy policy and terms of service across its online offerings, including its flagship search, Gmail and Google+ products, to make them easier to use, but the move could attract greater scrutiny from anti-trust regulators.

In an online blog post, Google said it expects to roll out the revised guidelines in over a month's time, consolidating more than 60 separate privacy policies it uses for its online products.

Google currently has more than 70 privacy policies covering all of its products.

Right now, users of Google products have to agree to a new set of privacy policy and terms of services almost every time they sign up for a new service.

This leaves them with an option to opt out of certain services like Google+ or Picasa.

After the new policy comes into effect, user information from most Google products will be treated as a single trove of data, which the company could use for its targeted advertising dollars, raising potential red flags for anti-trust regulators.

"If you're signed in, we may combine information you've provided from one service with information from other services," Google's director of privacy, product and engineering, Alma Whitten wrote in blog post.

"In short, we'll treat you as a single user across all our products, which will mean a simpler, more intuitive Google experience."

The announcement comes days after Google's decision to personalize its search feature drew criticism over privacy and anti-trust issues.

Online privacy has come under scrutiny from anti-trust regulators as a handful of web giants have been accused of compromising user privacy to attract advertisers.

Late last year, Facebook settled with the U.S. FTC agreeing to be regulated for a period of 20 years whenever it decided to change its privacy policy.

In 2010, the FTC settled charges with Twitter, after the agency alleged that the social networking service had failed to safeguard users' personal information.

U.S. regulators are reportedly looking into whether Google manipulates its search results to favor its own products and have expanded the probe to include Google+.

"Regulators globally have been calling for shorter, simpler privacy policies - and having one policy covering many different products is now fairly standard across the Web," Whitten said in the post.

The revised policy will take effect on March 1, the blog post said.

Republican Presidential Candidates on Repealing Obamacare (ContributorNetwork)

In March, the Supreme Court will consider the constitutionality of President Barack Obama's health care reform legislation, Obamacare. The court must determine whether the individual mandate component of the law, which effectively forces Americans to buy health insurance, is a power extended by the Congress' ability to regulate interstate commerce.

At the most recent South Carolina GOP debate, the Republican presidential candidates had an opportunity to voice their opinions on Obamacare. Here is what they said, according to a debate transcript provided by the Chicago Sun-Times:

* Mitt Romney

: "We have to go after a complete repeal. And that's going to have to happen with a House and a Senate, hopefully that are Republican. If we don't have a Republican majority, I think we're going to be able to convince some Democrats that when the American people stand up loud and clear and say, we do not want Obamacare, we do not want the higher taxes, we do not want a $500 billion cut in Medicare to pay for Obamacare. I think you're going to see the American people stand with our president and say, let's get rid of Obamacare."

* Newt Gingrich: "You have to elect a House, a Senate and a president committed to that (repealing the legislation). It has to be a major part of the fall campaign. And I think that, frankly, on our side with any of us, it's going to be a major part of the fall campaign. The American people are frightened of bureaucratic centralized medicine, they deeply distrust Washington, and the pressure will be to repeal it. ? Why is President Obama for young people being allowed to stay on their parents' insurance until 26? Because he can't get any jobs for them to go out and buy their own insurance. I mean, I have an offer to the parents of America: Elect us, and your kids will be able to move out, because they'll have work."

* Rick Santorum: "The core of Obamacare is an individual mandate. It is what is being litigated in the Supreme Court right now. It is government top-down telling every business and every American what kind of health care that you will have. That is the problem with Obamacare at the core of it. And the speaker supported it repeatedly for a 10-year period. So when he goes and says, I can, you know, run rings around President Obama in a Lincoln-Douglas debate, you can't run rings around the fact, Newt, that you supported the primary core basis of what President Obama's put in place."

* Ron Paul: "I had the privilege of practicing medicine in the early '60s, before we had any government. It worked rather well, and there was nobody on the street suffering with no medical care. But Medicare and Medicaid came in and it just expanded. But even when we had the chance to cut back on it, when we had a Republican Congress and a Republican president, we gave them prescription drug programs. Senator Santorum supported it. You know, that's expanding the government! ?We will get rid of all this government program, unfortunately because we're going bankrupt and you're going to have runaway inflation and our checks are going to bounce. And that's going to be a lot worse problem than we're facing tonight."

A big leap toward lowering the power consumption of microprocessors

The first systematic power profiles of microprocessors could help lower the energy consumption of both small cell phones and giant data centers, report computer science professors from The University of Texas at Austin and the Australian National University.

Their results may point the way to how companies like Google, Apple, Intel and Microsoft can make software and hardware that will lower the energy costs of very small and very large devices.

"The less power cell phones draw, the longer the battery will last," says Kathryn McKinley, professor of computer science at The University of Texas at Austin. "For companies like Google and Microsoft, which run these enormous data centers, there is a big incentive to find ways to be more power efficient. More and more of the money they're spending isn't going toward buying the hardware, but toward the power the datacenters draw."

McKinley says that without detailed power profiles of how microprocessors function with different software and different chip architectures, companies are limited in terms of how well they can optimize for energy usage.

The study she conducted with Stephen M. Blackburn of The Australian National University and their graduate students is the first to systematically measure and analyze application power, performance, and energy on a wide variety of hardware.

This work was recently invited to appear as a Research Highlight in the Communications of the Association for Computer Machinery (CACM). It's also been selected as one of this year's "most significant research papers in computer architecture based on novelty and long-term impact" by the journal IEEE Micro.

"We did some measurements that no one else had done before," says McKinley. "We showed that different software, and different classes of software, have really different power usage."

McKinley says that such an analysis has become necessary as both the culture and the technologies of computing have shifted over the past decade.

Energy efficiency has become a greater priority for consumers, manufacturers and governments because the shrinking of processor technology has stopped yielding exponential gains in power and performance. The result of these shifts is that hardware and software designers have to take into account tradeoffs between performance and power in a way they did not ten years ago.

"Say you want to get an application on your phone that's GPS-based," says McKinley, "In terms of energy, the GPS is one of the most expensive functions on your phone. A bad algorithm might ping your GPS far more than is necessary for the application to function well. If the application writer could analyze the power profile, they would be motivated to write an algorithm that pings it half as often to save energy without compromising functionality."

McKinley believes that the future of software and hardware design is one in which power profiles become a consideration at every stage of the process.

Intel, for instance, has just released a chip with an exposed power meter, so that software developers can access some information about the power profiles of their products when run on that chip. McKinley expects that future generations of chips will expose even more fine-grained information about power usage.

Software developers like Microsoft (where McKinley is spending the next year, while taking a leave from the university) are already using what information they have to inform their designs. And device manufacturers are testing out different architectures for their phones or tablets that optimize for power usage.

McKinley says that even consumers may get information about how much power a given app on their smart phone is going to draw before deciding whether to install it or not.

"In the past, we optimized only for performance," she says. "If you were picking between two software algorithms, or chips, or devices, you picked the faster one. You didn't worry about how much power it was drawing from the wall socket. There are still many situations today?for example, if you are making software for stock market traders?where speed is going to be the only consideration. But there are a lot of other areas where you really want to consider the power usage."

Colo. girl escapes apparent kidnapper, calls 911 (AP)

COLORADO SPRINGS, Colo. ? A missing 9-year-old girl escaped an apparent kidnapper and called 911 herself from a convenience store in Colorado Springs on Friday, police said.

The Pueblo girl was reported missing Thursday night after she failed to return home from school.

The car of the man accused of kidnapping the girl broke down Friday morning in Colorado Springs, and a passerby gave them a ride to a Circle K, police said.

The girl ran into the store and asked to use the phone to call her uncle but instead called 911, which prompted the man to take off, authorities said.

Police identified the suspect as Jose Garcia, 29, but haven't said how they connected him to the kidnapping. Colorado Springs police spokeswoman Barbara Miller said he was in custody Friday afternoon.

Pueblo County court records said Garcia was wanted on suspicion of kidnapping and sex assault on a child. Pueblo police did not immediately return a call seeking comment on the potential charges.

Efren Vialpando told The Gazette ( http://bit.ly/Ao9LgD) he saw the girl come in the Circle K with two black eyes and a bruise on her lip and face. She had refused to leave the store with the man, saying, "I ain't going nowhere. I'm waiting for my momma." He said the suspect fled after that.

A Circle K employee declined to comment, citing store policy.

The girl was taken to a hospital Friday morning. Police spokeswoman Barbara Miller said details of the girl's condition won't be released because of her age.

The FBI helped with the investigation.

Etta James Dies At 73

Sad news to report this morning, Etta James dies at the age of 73 after a long battle with leukemia. The legendary blues singer, whose version of “At Last” is a classic, died at Riverside Community Hospital in California, with her family by her side. The musical world has lost a great one. James’ manager, Lupe De Leon, confirmed the sad news of her passing to CNN this morning: “This is a tremendous loss for the family, her friends and fans around the world. She was a true original who could sing it all ? her music defied category. I worked with Etta for over 30 years. She was my friend and I will miss her always.” During a musical career that spanned 50 years, Ms. James was a multiple Grammy winner and was inducted in to the Rock and Roll Hall of Fame in 1993. In addition to the iconic “At Last”, she would later release hits such as “Id Rather Go Blind” (see the video below, gives me goosebumps each time I watch it) and “Tell Mama”, just to name a few. She served as an inspiration to many singers, including Celine Dion, Bonnie Raitt, Adele, Christina Aguilera [...]

'The Pill' Can Help Ease Period Pain, Study Finds (HealthDay)

TUESDAY, Jan. 17 (HealthDay News) -- There's more evidence that use of the oral contraceptive pill can help ease the cramps, bloating and other pain some women experience during their period.

Some previous research, as well as anecdotal evidence, have suggested that the Pill could help women with painful periods, but a 2009 review of all available research concluded there was limited evidence for such a conclusion.

The new findings, from a Swedish study that has been running for 30 years, show that women who used the combined birth control pill (estrogen plus progestin) suffered less severe pain than women who did not use the Pill, the researchers said.

Their study findings appear online Jan. 18 in the journal Human Reproduction.

Experts estimate that pain associated with menstrual periods accounts for 600 million lost working hours and $2 billion in lost productivity in the United States each year.

One expert in the United States noted that doctors have long used the Pill to help ease such symptoms.

"Many obstetrician/gynecologists have used oral contraceptive pills to help alleviate menstrual pain, otherwise known as dysmenorrhea," said Dr. Jenifer Wu, an obstetrician/gynecologist at Lenox Hill Hospital in New York City. "This is technically an off-label use of these commonly prescribed medications," she added.

The Swedish researchers noted that younger women typically suffer more from painful periods than older women. And while they did find that symptoms eased somewhat with increasing age, the effects of age and Pill use were independent of each other and use of the Pill had a greater effect overall.

The study included three groups of women who turned 19 in 1981, 1991 and 2001. Each group included 400 to 520 women, who were asked about their pattern of menstruation and menstrual pain, reproductive history, contraceptive use, height and weight.

The women provided this information at ages 19 and 24.

"By comparing women at different ages, it was possible to demonstrate the influence of [the Pill] on the occurrence and severity of dysmenorrhea, at the same time taking into account possible changes due to increasing age," Dr. Ingela Lindh, of the Institute of Clinical Sciences, Sahlgrenska Academy at Gothenburg University, said in a journal news release. "We found there was a significant difference in the severity of dysmenorrhea depending on whether or not the women used combined oral contraceptives."

Dr. Steven Goldstein, an obstetrician/gynecologist at NYU Langone Medical Center in New York City, said: "The study results are not surprising. It's gratifying to see researchers documenting scientifically what practitioners have been seeing for a very long time. The amount of discomfort from a woman's period with a combination birth control pill is a fraction of what it is without the Pill. There is a diminution of pain from the Pill."

For her part, Wu believes that "doctors should include a discussion of all the benefits and risks when presenting birth control options, and the improvement of dysmenorrhea is a significant benefit to oral contraceptive pills."

Common substance may fight food poisoning hazard

(AP) ? A substance found in nuts and whole grains may someday help doctors fight the kind of food poisoning that sickened thousands of people in Europe last summer, a study in mice suggests.

While a variety of germs can cause food poisoning, the European outbreak involved a dangerous strain of the bacterium E. coli. It infects people and pumps out a poison called Shiga toxin. Some other bacteria also produce this toxin, which overall causes more than 1 million deaths a year worldwide. The European food poisoning outbreak included about 4,000 people and 50 deaths.

There's no definitive treatment for Shiga toxin. But in Friday's issue of the journal Science, scientists report that they could protect mice against a lethal dose by injecting them with the mineral manganese.

The animals were injected daily, starting five days before they were exposed to the toxin. While untreated mice died within four days, the injected mice remained healthy. The manganese made the toxin vulnerable to being destroyed by cells.

Scientists still need to do more research before they can assess the usefulness of manganese in treating people. Manganese is already approved for medical use and it's inexpensive, they note. So that might make it especially useful in developing countries, where nearly all cases of Shiga toxin poisoning occur, wrote the researchers, from Carnegie Mellon University in Pittsburgh.

Adele's 21 Ties Titanic Soundtrack With 16th Week At #1

British belter's smash album catches up to 1997 blockbuster album with its 16th non-consecutive week atop the Billboard chart.

Move over James Cameron (and Celine Dion): Adele just landed her Sweet 16th.

Yes, once again the British belter's 21 album tops the Billboard 200 chart, according to figures provided by Nielsen SoundScan, the 16th (non-consecutive) week it sits at #1. The mark ties it with the soundtrack to the 1997 blockbuster "Titanic," which was buoyed by Dion's massive "My Heart Will Go On."

Up next for Adele? Well, first, it's Billy Ray Cyrus' Some Gave All, which topped the Billboard charts for 17 weeks in 1992, followed by Garth Brooks' Ropin' the Wind, which was #1 for 18 weeks. Then, it's the 1992 soundtrack to "The Bodyguard," which, powered by Whitney Houston's takes on "I'm Every Woman" and "I Will Always Love You," spent 20 weeks atop the Billboard albums chart. Oh, and Elvis Presley's Blue Hawaii, which also spent 20 weeks at #1. Rarefied air, indeed.

21 sold more than 104,000 copies to take the top spot, easily outpacing the week's biggest debut, the David Crowder Band's Give Us Rest, which sold nearly 51,000 copies to open at #2. The Black Keys' El Camino holds strong at #3 for a second week, selling more than 36,000 copies and moving past the 500,000 mark in total sales in the process. Drake's Take Care (nearly 32,000 copies sold) and Snow Patrol's new Fallen Empires (nearly 31,000 copies) round out the top five.

Young Jeezy's TM 103: Hustlerz Ambition is in at #6, with sales of nearly 24,000 copies, followed by Rihanna's Talk That Talk at #7 (nearly 22,000 copies), Coldplay's Mylo Xyloto at #8 (nearly 20,000 copies), Nickelback's Here and Now at #9 (19,000-plus copies) and the 40th installment of the ubiquitous Now compilation, which comes in at #10 with sales of more than 17,000 copies.

Outside the top 10, there were debuts by Yo Gotti, whose Live From the Kitchen sold more than 16,000 copies to open at #12, Rebelution's Peace of Mind (#13, also posting sales of more than 16,000 copies), critical darling Lana Del Rey's self-titled EP (#20, nearly 14,000 copies sold) and the soundtrack to "Joyful Noise," which bowed at #21 with sales of more than 13,000 copies.

Oil price rises on signs of improving US economy (AP)

WASHINGTON ? Oil prices are rising on fresh signs of an improving U.S. economy that could lead to stronger demand for gasoline and other energy products.

Benchmark oil rose 50 cents to $101.21 per barrel on Wednesday in New York. Brent crude fell 50 cents to $111.03 per barrel in London.

The Federal Reserve says factory production in December expanded by the most in a year, as consumers bought more vehicles and businesses spent more on machinery and computers.

Investors also are encouraged by news that the International Monetary Fund is seeking new funding resources to help struggling European countries.

Meanwhile, AAA says the national average for retail gas is $3.38 per gallon. That's about 16 cents more than a month ago and nearly 28 cents more than a year ago.

Murder charge awaits man who took Rockefeller name (AP)

LOS ANGELES ? In 1985, Clark Rockefeller did not exist. The pseudonym, which was one of many fake identities assumed by a German immigrant, would surface years later when he began cutting a swath across high society claiming to be an heir to the Rockefeller fortune.

As a world class impostor, he conned people into believing he was a physicist, an art collector, a ship captain and a financial adviser who renegotiated debt for small countries. Even his wealthy wife was unaware of his true identity.

But when Christian Gerhartsreiter enters a courtroom for a preliminary hearing Wednesday, he will finally be himself: a convicted kidnapper facing a charge of murdering the son of his former landlady a quarter century ago, when he lived in California under one of his many pseudonyms. He is famous now; his story has been told in a TV movie.

Like most cold cases, the murder charge stemming from the death 26 years ago may be tough to prove. Evidence deteriorates, and witness memories fade over years. But prosecutors have had time to develop theories, and the science of forensic analysis has advanced.

Much of the prosecution's case will hinge on three plastic bags of human bones found during the excavation for a swimming pool at a San Marino home in 1994. At first, it was not certain that the bones were even human. But through extensive testing, they were linked to John Sohus, 27, a computer engineer who disappeared in 1985. It was a difficult match because Sohus was adopted and DNA from relatives was not readily available.

"Modern technology has helped us to identify those bones as the Sohus bones," said Los Angeles County Sheriff's spokesman Steve Whitmore, declining to disclose details.

Sohus' wife, Linda, also disappeared in 1985. No trace of her was found, though postcards purportedly written by her were sent to friends and relatives after she disappeared. The postcards were supposedly mailed from France, but the handwriting was never authenticated. Authorities presume she is dead, but they have not charged Gerhartsreiter with her death.

The other person who disappeared from San Marino at about the same time was a tenant then known as Chris Chichester, another of Gerhartsreiter's identities.

Police explored various possibilities, including that Chichester had been in love with Linda Sohus and murdered her husband in a fit of jealousy. Authorities came close to finding him in the late 1980s when he was pulled over in Greenwich, Conn., driving Sohus' truck. But by the time the Department of Motor Vehicles had confirmed it was Sohus' truck, Chichester and the vehicle had vanished.

The man at the center of the mystery eluded authorities for years, moving to New York and then Boston where he hobnobbed in high society. He claimed to be an heir to the fabled Rockefeller oil fortune, marrying a woman with whom he had a daughter. She divorced him when she found out he had duped her.

Last year he was convicted of kidnapping his daughter in Boston during a bitter custody dispute. Gerhartsreiter is serving a four- to five-year prison sentence. He would be eligible for parole this year if he was not awaiting trial in California on a charge that could bring him 26 years to life in prison if convicted.

Prosecutors have 30 to 40 witnesses ready for the two-week preliminary hearing, many of whom are forensic experts. They are seeking to convince a judge there is probable cause to believe that Gerhartsreiter is a killer and should be held for trial.

One of Gerhartsreiter's Boston attorneys, Jeffrey Denner, said it was unlikely that the defense will put on a case at this stage of the proceedings. He said that Gerhartsreiter is "appropriately somber" as he faces the court hearing.

At the kidnapping trial, Denner claimed his client was suffering from a delusional disorder and was legally insane when he snatched his daughter during a supervised visit. Prosecutors portrayed him as a master manipulator who used multiple aliases and told elaborate lies about his past since moving to the United States in the 1970s.

The complaint against him lists five different aliases: Christopher Chichester, Clark Rockefeller, Christopher Crowe, C. Crowe Mountbatten and Charles "Chip" Smith.

Denner has said Gerhartsreiter is not a violent man, and prosecutors have not yet offered a motive that might have led him to murder. The motive and other details of the case could be disclosed at the preliminary hearing.

Perry: Marines in video are 'kids,' not criminals

Republican presidential hopeful Rick Perry on Sunday accused the Obama administration of "over-the-top rhetoric" and "disdain for the military" in its condemnation of a video that purportedly shows four Marines urinating on corpses in Afghanistan.

Perry's comments put him at odds with Sen. John McCain, the top Republican on the Senate Armed Services Committee, who said the images could damage the war effort.

"The Marine Corps prides itself that we don't lower ourselves to the level of the enemy," McCain said when asked about Perry's position. "So it makes me sad more than anything else, because ... I can't tell you how wonderful these people (Marines) are. And it hurts their reputation and their image."

No one has been charged in the case, but officials in the U.S. and abroad have called for swift punishment of the four Marines. Defense Secretary Leon Panetta said last week that he worried the video could be used by the Taliban to undermine peace talks.

Texas Gov. Perry said the Marines involved should be reprimanded but not prosecuted on criminal charges.

"Obviously, 18-, 19-year-old kids make stupid mistakes all too often. And that's what's occurred here," Perry told CNN's "State of the Union."

He later added: "What's really disturbing to me is the kind of over-the-top rhetoric from this administration and their disdain for the military."

Later appearing on the same show, McCain said he disagreed.

"We're trying to win the hearts and minds" of the Afghanistan population, he said. "And when something like that comes up, it obviously harms that ability."

Hawaii, New York top 3rd round of Miss America

(AP) ? A jump roping Miss Hawaii topped contestants in the third round of the Miss America talent competition in Las Vegas, while a swimsuit-clad Miss New York scored honors in the lifestyle and fitness category.

Miss Hawaii Lauren Cheape won a $2,000 scholarship for her routine to "Hawaii Five-O" at Thursday night's preliminary. The talent portion is 35 percent of a contestant's score.

Miss New York Kaitlin Monte earned a $1,000 scholarship after appearing in a Monte Carlo Komplique swimsuit. The fitness category is 15 percent of a contestant's score.

The two join Miss Wisconsin and Miss Oklahoma, who won for talent in preliminaries earlier this week. Miss Utah and Miss Texas won swimsuit in rounds one and two.

The finals are Saturday at the Planet Hollywood Resort & Casino.
